What to Avoid When Choosing Job Candidates: Part 5

Hair, Health, Height & Weight:

Hair- It is generally considered a violation of Title VII to have a hair requirement that differs from men to women. However, it has not been a major issue in the courts as long as there has been no disparate impact on either sex.

Health- An applicant may be refused employment if he or she fails a physical examination as long as the requirements in the exam demonstrate that the applicant would not be able to perform on the job. For example, an employer can reject an applicant who fails a coordination test.

Height & Weight: Applicants protected by Title VII can be refused employment on the basis of a height or weight requirement provided the employer demonstrates job relatedness. An applicant who is 6’5” , for example, may be refused a flight attendant position due to safety restrictions.
